These terms and conditions apply to the Collie app (hereby referred to as "Application") for mobile devices that was created by Filipe Franchini Hruba (hereby referred to as "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

Intellectual Property Rights

Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

Service Modifications and Pricing

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or introduce charges for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you prior to implementation.

Account Security and Responsibility

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to:

  • Maintain the security of your phone and access to the Application
  • Keep your login credentials confidential
  • Notify the Service Provider immediately of any unauthorized access

The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Third-Party Services

The Application utilizes third-party services that have their own Terms and Conditions, including but not limited to:

  • Authentication services (Apple Sign-In, Google Sign-In)
  • Cloud database and backend services
  • Payment processing and subscription management services
  • Analytics services

By using the Application, you agree to comply with the terms of these third-party services as well.

Internet Connection and Data Usage

Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the Application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the Application, or other third-party charges. By using the Application, you accept responsibility for any such charges, including roaming data charges if you use the Application outside of your home territory (i.e., region or country) without disabling data roaming.

If you are not the bill payer for the device on which you are using the Application, you assume that you have obtained permission from the bill payer.

Device Responsibility

It is your responsibility to ensure that your device remains charged. The Service Provider cannot be held responsible if your device runs out of battery and you are unable to access the Service.

Freemium Model

The Application is offered as a Freemium service, which means:

Free Features

You can use the basic features of the Application at no cost, including:

  • Creating a household
  • Adding and managing pet information
  • Inviting household members
  • Basic scheduling and reminders

Premium Features

Premium features are available through an optional paid subscription ($3.99/month or equivalent in your currency). Premium features may include additional functionality, enhanced features, or advanced tools. The Service Provider reserves the right to modify, add, or remove premium features at any time.

In-App Purchases

Premium subscriptions are purchased through the Application via Apple's In-App Purchase system. Payment is processed by Apple, and their terms govern the transaction. You agree to Apple's App Store Terms of Service when making a purchase.

Subscriptions and Renewals

  • Subscriptions renew automatically at the end of each billing period unless canceled
  • You can cancel your subscription at any time through your Apple Account settings
  • Cancellation takes effect at the end of your current billing period
  • Refunds for unused portions of a subscription may be available through Apple according to their refund policy
  • The Service Provider does not process refunds directly; all refund requests must be handled through Apple

User-Generated Content and Pet Information

The pet information you add to the Application (including photos, names, breed information, and behavioral notes) is your content. By using the Application:

  • You retain ownership of your content
  • You grant the Service Provider a license to store, display, and use your content within the Application to provide the Service
  • The Service Provider will not use your content for marketing or public purposes without your explicit consent
  • All content is private to you and your invited household members unless otherwise specified

Household Management

When you create a household in the Application:

  • You are responsible for managing household members and their access to pet information
  • By inviting someone to your household, you grant them access to view and edit shared pet information
  • You can remove household members at any time, and they will lose access to the household's data
  • The Service Provider does not verify relationships or permissions between household members; you are responsible for ensuring all invitations are appropriate

Liability Limitation and Disclaimer

The Service Provider provides the Application "as is" without warranty of any kind, either express or implied. The Service Provider does not guarantee that:

  • The Application will meet your requirements
  • The Application will be uninterrupted, secure, or error-free
  • Any defects in the Application will be corrected
  • The Application will be compatible with all devices or operating system versions

Limitation of Liability

To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Application, even if the Service Provider has been advised of the possibility of such damages.

The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying on the functionality of the Application.

Application Updates

The Application may require updates from time to time. Operating system requirements may change, and you will need to download updates if you want to continue using the Application. The Service Provider does not guarantee that it will always update the Application to be relevant to you and/or compatible with the particular operating system version installed on your device.

However, you agree to always accept updates to the Application when offered to you. Failure to install updates may result in the Application not functioning properly or at all.

Service Termination

The Service Provider may wish to cease providing the Application and may terminate its use at any time without providing termination notice to you. Unless otherwise informed:

  • Your rights and licenses granted in these terms will end immediately upon termination
  • You must cease using the Application
  • You must delete the Application from your device
  • Upon deletion, you will lose access to your data unless you have downloaded it previously

The Service Provider recommends downloading or exporting your data regularly to prevent loss.

Data Upon Account Deletion

If you delete your account:

  • Your personal information will be retained for 30 days to allow for account recovery
  • After 30 days, your data will be permanently deleted from our servers
  • Household members will no longer have access to the deleted household's data
  • The Service Provider cannot restore deleted data after this period

User Conduct

By using the Application, you agree not to:

  • Use the Application for any illegal purposes or in violation of any applicable laws
  • Attempt to hack, modify, or reverse-engineer the Application
  • Use the Application to harass, abuse, or harm others
  • Upload or distribute malware, viruses, or malicious code
  • Attempt to gain unauthorized access to the Application or its systems
  • Violate anyone's intellectual property rights

Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any material changes by posting the new Terms and Conditions on this page and updating the "Effective Date" above.

Your continued use of the Application following the posting of revised Terms and Conditions means that you accept and agree to the changes.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
